If you served your country during World War I, World War II, the Korean War, or Vietnam War, you may be entitled to a special pension available only to wartime Veterans to help pay for your long-term care costs. Your eligibility depends on your net worth and monthly income compared to your monthly “unreimbursed medical expenses.” If you or a loved one is already in long-term care, our attorneys will conduct a thorough analysis of your current assets and income and medical expenses and map out a clear path to eligibility.

Even if you are not in long-term care and don’t anticipate needing it anytime soon, there are various options available to prevent certain assets from disqualifying you from Veterans benefits so that those assets do not have to be spent down and will still be there when you and your family need them. But in order for these options to work, you typically have to do “pre-planning” at least 3 years before you need long-term care and apply for Veterans benefits. This is because the VA has a 3-year “lookback period” that penalizes most asset transfers made within 3 years prior to your application.

Given this time limit, it’s critical to start the planning process as soon as possible. Even if you feel confident you won’t need long-term care in the next 3 years, it’s always better to get started sooner rather than later. If you wait too long, then you may lose the opportunity to take advantage of your Veterans benefits when they could have served you most.
